Sample Performance Contract
This document represents a binding agreement between Andrew Horowitz, and NAME, STREET
ADDRESS, CITY, STATE, ZIP referred to as “CLIENT.”
I. CLIENT agrees to hire Mr. Horowitz on Wednesday, October X, 200X at The Center
for the Arts, George Mason University in Fairfax, Virginia from 8:45 to 10:45 PM to play
ragtime/background/coctail piano music, for a fee of $XX.
II. This fee is determined by an hourly rate of $XX and a travel fee of $XX.
III. Mr. Horowitz will play for forty-five minutes of each hour.
IV. Mr. Horowitz will arrive at the site by 8:30 PM on the performance date wearing black tie.
V. CLIENT agrees to provide piano, tuned and in good condition. Mr. Horowitz retains the
sole right to determine whether or not piano is “tuned and in good condition.” If the piano is not tuned
and in good condition, Mr. Horowitz will refund 50% of the total fee, but will not be compelled to
perform.
VI. Payment is to be made as follows: The CLIENT will provide Mr. Horowitz a 100% deposit
of $XX by check not less than ten days in advance of the performance. 50% of this deposit is non-
refundable. No refunds will be made within ten days of the performance.
OR Payment is to be made as follows: The CLIENT will provide Mr. Horowitz a 50% deposit of
$XX by check not less than ten days in advance of the performance. This deposit will be non-
refundable. CLIENT will provide Mr. Horowitz the remaining 50% of the charge due, or $XX, in cash
when Mr. Horowitz arrives at the job site. Mr. Horowitz shall not be obligated to begin work until
receiving this balance of charges due.
VII. It may be possible to extend or reduce the playing time, or change the time, date, or location,
among other possible changes. But no changes are guaranteed. Once signed, this document becomes
binding on both Mr. Horowitz and the CLIENT and changes will be made only by mutual written
agreement.
VIII. In the highly unlikely event of severe illness or other extreme emergency that prevents the
Mr. Horowitz from appearing, 100% of any money paid will be refunded to the CLIENT.
